Court-led appointment initiated by the Department of Insolvency when acting in the role of Liquidator.

What does this entail?

An application for a Special Manager (SM) can be made to the court by the Department of Insolvency (the Department), discharging the duties of the Official Receiver when acting as liquidator where the Department considers it appropriate that the company requires specialised management of its affairs going beyond the remit and/or expertise of the Department.

This application is supported by the Department’s affidavit, outlining the need for the appointment of a SM.

The court order for the appointment of the SM may determine the duration of the appointment and sets out the powers of the SM.
