What does this entail?
Pursuant to the Charging Orders Law of 1992 (31 (I)/1992), a creditor who has obtained a judgment against a debtor, may, for the purpose of enforcing a judgement, apply to the court for the issuance of a charging order over the interest of a judgement debtor of assets which are covered by the Charging Orders Law.
The effect of a Charging Order is to prevent the debtor from dissipating his/her assets, although the issuing of a charging order does not constitute a method of execution. When coupled with an Order for Sale, the issuance of both orders shall be deemed to be a method of execution.
The Court may also appoint a Receiver over assets subject to a charging order to ensure the recovery of the secured amount through the realisation of assets caught by the Charging Orders Law, which includes shares and dividends.
