What does this entail?
The ADGM framework permits secured creditors to appoint receivers pursuant to fixed or floating charges, aligned with the relevant ADGM regulations. Receivers in the ADGM must be registered ADGM Insolvency Practitioners and are expected to act diligently, transparently and in good faith.
The receivers' role is to maximise the return to secured creditors from realisation of charged assets and their primary duty of care is to the appointing creditor and the guarantors.

When is it appropriate
This mechanism is appropriate where a secured creditor requires a swift, flexible enforcement route following default, particularly where court proceedings are unnecessary or would cause delay. It is especially useful where assets have standalone value and recoveries can be maximised through targeted action.
How we can help
We advise financial institutions and other secured creditors on enforcement options, the appointment process and risk management. We accept appointments as receivers, where instructed, take control of charged assets and devise realisation strategies focused on value preservation.
