What does this entail?
Examinership is a court-supervised restructuring process that provides a company with temporary protection from creditor enforcement while its financial viability is assessed. During the moratorium period, an Examiner or an Interim Examiner evaluates the company’s prospects of survival and puts forward proposals to classes of creditors for a restructuring plan designed to preserve employment, as well as the business and assets as a going concern.
The process allows for debt restructuring, renegotiation of contracts, thus attracting potential investment, while balancing creditor interests with the objective of business survival. Court oversight ensures transparency and fairness throughout.

When is it appropriate?
Examinership is appropriate where a company is facing immediate financial pressure or imminent creditor enforcement but has a reasonable prospect of survival if afforded temporary court protection. It is often used in situations where urgent intervention is required to stabilise operations, preserve value and protect employment.
Early advice is critical, as timing and eligibility are key considerations in determining whether examinership is viable.
