What does this entail?
DIFC Administration is intended to support distressed companies by placing them under the control of an administrator, while a statutory moratorium protects the company from creditor enforcement and restricts the appointment of receivers without court consent. The process is designed to stabilise operations and create a platform for restructuring.
The administrator assumes control of the company’s affairs. Directors may remain involved under supervision depending on circumstances, but the administrator’s role is to act independently and implement a strategy aimed at preserving value and improving outcomes for stakeholders.

When is it appropriate?
Where an application for a Rehabilitation Plan has been made and there is evidence of fraud, mismanagement, or incompetence, creditors may apply to the Court for the appointment of an Administrator. During the period for which the order for Administration is in force, the affairs, business and property of the business shall be managed by the Administrator.
Administration is appropriate where a company is, or is likely to become, unable to pay its debts, but has a reasonable prospect of surviving by restructuring or preserving value through a formal insolvency process.
